Marvel and DC lost the “Super Hero” trademark

The US Patent and Trademark Office has canceled Marvel and DC‘s claim to several trademarks. The challenge to them came from Superbabies Limited, a small comic publisher. DC accused that company of infringing the “Super Hero” marks and threatened legal action after Superbabies applied for U.S. trademarks covering the “Super Babies” name.

Marvel and DC didn’t respond to the challenge by the July 24, 2024 due date. That resulted in the cancellation.

The USPTO canceled four trademarks. The oldest, “Super Hero,” was registered in 1967. The two companies still have “Super Heroes” which was registered in 2018 and “Super-Villain” which was secured in 1985.
