
The Court of Appeals for the Federal Circuit, in response to an appeal from the administration, has stayed the lower court order ending most tariffs. The stay was temporary, with briefs due in the coming weeks on the issue. The companies that sued to end the tariffs have until June 5 to respond to the request for a stay, and the administration has until June 9 to respond to the response.
The temporary stay of the lower court order affects the ruling this week by the U.S. Court of International Trade that the tariffs imposed on China and most other countries were unlawful (see “Federal Court Blocks Tariffs”).
The uncertainty continues.
